These Terms & Conditions ("Terms") govern your access to and use of the SmartAccumulator website and any related content, features and services (collectively, the "Service"). By accessing or using SmartAccumulator, you agree to be bound by these Terms. If you do not agree, you must not use the Service.

1. Nature of the Service – Sports Predictions Only

SmartAccumulator provides sports predictions, match analysis and informational content only. We do not operate as a bookmaker, casino, betting exchange, or gambling platform, and we do not process, accept, or handle any bets, stakes, deposits or withdrawals on behalf of users.

All content published on SmartAccumulator, including but not limited to predictions, suggested accumulators, opinions, statistics, and analyses, is provided for informational and entertainment purposes only. Nothing on this website should be interpreted as:

• an offer or solicitation to place a bet or engage in gambling;
• financial, investment, legal or tax advice;
• a guarantee or promise of achieving any particular outcome or profit.

2. Eligibility & User Responsibility

Although SmartAccumulator does not itself provide gambling services, our content relates to sports events which may be used by users in connection with betting or gambling on third-party platforms. For that reason, the Service is intended only for adults aged 18 or older, or the minimum legal age required in your jurisdiction to view such content, whichever is higher.

4. No Guarantee of Results & Risk Disclosure

Sports results are inherently uncertain. While SmartAccumulator may use statistical models, historical data and subjective analysis to produce predictions, no prediction is guaranteed to be correct.

By using the Service, you acknowledge and agree that:

• past performance does not guarantee future results;
• even strong historical win rates are subject to variance and losing streaks;
• following any prediction may result in financial loss if you choose to place a bet based on it;
• you should never stake money you cannot afford to lose.

If you feel that betting or gambling is negatively impacting your life or finances, you should stop immediately and seek help from a recognised responsible gambling organisation in your country.

5. Third-Party Bookmakers & External Services

SmartAccumulator may refer to or discuss odds, markets or offers available from third-party betting operators ("Bookmakers"). Such references are for informational purposes only. SmartAccumulator:

• is not affiliated with, owned by, or in partnership with any Bookmaker, unless explicitly stated;
• does not operate or control any Bookmaker website, platform or mobile application;
• is not responsible for any account openings, verification processes (KYC), limitations, closures or disputes with Bookmakers.

Any relationship you have with a Bookmaker (including creating an account, placing bets, deposits, withdrawals, bonuses, disputes or complaints) is strictly between you and that Bookmaker. SmartAccumulator accepts no responsibility or liability for any issues arising from your interactions with third-party operators.

6. Accounts, Subscriptions & Payments

SmartAccumulator may offer free and/or paid access to certain content or features, including recurring subscriptions. Payment processing may be handled by third-party payment providers. By purchasing a subscription or digital product, you agree to the specific pricing, billing frequency and conditions presented at checkout.

Because our products consist of digital content delivered immediately (such as access to predictions and analysis), you acknowledge that:

• access to the Service may start as soon as payment is confirmed;
• once access has begun, the content is considered "used" or "consumed";
• in many jurisdictions, this affects your statutory right of withdrawal for digital content.

Unless explicitly stated otherwise at the time of purchase, all fees are non-refundable. If you believe you have been charged in error, you should contact us using the details in the Contact section of these Terms.

7. Acceptable Use & Prohibited Conduct

You agree to use SmartAccumulator only for lawful purposes and in a manner that does not infringe the rights of others or restrict or inhibit anyone else’s use and enjoyment of the Service. In particular, you must not:

• copy, scrape, harvest, reproduce or redistribute our content without written permission;
• use automated bots or scripts to access, query or download content at scale;
• attempt to reverse engineer, decompile or otherwise interfere with the operation of the Service;
• use the Service for any illegal, fraudulent or unauthorised purpose;
• misrepresent your affiliation with SmartAccumulator or impersonate our staff.

8. Intellectual Property

Unless otherwise indicated, all content on SmartAccumulator – including text, graphics, logos, icons, design, layout and underlying code – is the intellectual property of SmartAccumulator or its licensors and is protected by applicable copyright and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable licence to access and use the Service for your personal, non-commercial use only. You may not copy, redistribute, sell, sublicense or otherwise exploit any content from SmartAccumulator without our prior written consent.

9. Limitation of Liability

To the maximum extent permitted by applicable law, SmartAccumulator and its owners, directors, employees, contractors and agents shall not be liable for any direct, indirect, incidental, consequential, special, punitive or exemplary damages, including (without limitation):

• loss of profits, revenue, data or business opportunities;
• financial losses arising from bets or gambling activities you choose to undertake;
• losses caused by reliance on any prediction, analysis or content published on the Service;
• losses arising from technical issues, interruptions, delays, errors, or omissions in the Service.

If, notwithstanding the above, SmartAccumulator is found to be liable to you for any damages or losses in connection with the Service, such liability shall in all cases be limited to the lesser of:

• the total amount you have paid to SmartAccumulator in subscription fees during the six (6) months immediately preceding the event giving rise to the claim; or
• one hundred (100) Euros.

10. Indemnification

You agree to indemnify, defend and hold harmless SmartAccumulator and its owners, directors, employees, contractors and agents from and against any and all claims, liabilities, damages, losses, costs, expenses or fees (including reasonable legal fees) arising out of or related to:

• your use of or access to the Service;
• your violation of these Terms;
• any betting, gambling or financial decisions you make based on information from SmartAccumulator;
• your violation of any law or the rights of any third party.

11. Service Availability, Changes & Suspension

SmartAccumulator is provided on an "as is" and "as available" basis. We do not guarantee that the Service will be:

• available at all times or without interruption;
• free from errors, bugs, security vulnerabilities or omissions;
• compatible with all devices, browsers or operating systems.

We reserve the right, at our sole discretion and without prior notice, to:

• modify, update, suspend or discontinue any part of the Service;
• impose limits on certain features or restrict access to parts or all of the Service;
• suspend or terminate your access if we reasonably believe you have violated these Terms or applicable law.

12. Compliance with Local Laws

The Service is accessible globally, but this does not imply that the content is appropriate or lawful in every jurisdiction. If you choose to access SmartAccumulator from outside the Netherlands, you do so on your own initiative and are responsible for compliance with local laws.

SmartAccumulator does not knowingly target users in jurisdictions where viewing sports predictions linked to betting would be unlawful. If such restrictions apply to you, you must not use the Service.

13. Governing Law & Jurisdiction

These Terms and any dispute or claim arising out of or in connection with them (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict of law principles.

You agree that the courts of the Netherlands shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms or the Service, subject always to any mandatory consumer protection rules that may apply in your country of residence.

14. Changes to These Terms

We may update or modify these Terms from time to time, for example to reflect changes in law, our business or the Service. When we do so, we will revise the "Last updated" date at the top of this page. The updated Terms will become effective as soon as they are posted on this page.

Your continued use of SmartAccumulator after any changes to the Terms constitutes your acceptance of the updated version. If you do not agree with the updated Terms, you must stop using the Service.
